USCIS Expands Premium Processing to All I-140 Petitions

Beginning January 30, 2023, USCIS will accept premium processing requests for all pending and initial I-140 Immigrant Petitions for Multinational Executive and Manager (EB-1C) and I-140 Immigrant Petitions for National Interest Waivers (EB-2 NIW). Before their latest announcement, USCIS had been incrementally expanding premium processing for pending EB-1C and EB-2 NIW I-140 petitions. 

USCIS also announced that in March 2023, they will expand premium processing to pending Forms I-765, Applications for Employment Authorization, for students seeking Optional Practical Training (OPT) and STEM OPT extensions. In April 2023, USCIS will expand premium processing to all OPT and STEM OPT applications. 

Finally, USCIS plans on expanding premium processing to Form I-539, Application to Extend/Change Nonimmigrant Status. USCIS anticipates expanding premium processing for certain student and exchange visitors with pending Form I-539 applications in May and certain student and exchange visitors who are filing initial Form I-539 applications in June.
