USCIS Continues to Expand Premium Processing for Certain I-140 Petitions

USCIS has announced the next phase of premium processing availability for certain types of pending I-140 Immigrant Petitions for Alien Workers. 

Beginning September 15, 2022 USCIS began accepting premium processing upgrade requests for: 

  • I-140 Immigrant Petition for Multinational Executive and Manager (EB-1C) received on or before January 1, 2022; and 

  • I-140 Immigrant Petitions for National Interest Waivers (EB-2 NIW) received on or before February 1, 2022. 

USCIS will have 45 calendar days to adjudicate the pending petition after a premium processing request is filed, instead of the 15-day timeline used for other types of petitions.

USCIS is not accepting premium process requests for pending EB-1C or EB-2 NIW I-140s filed after the dates listed above. Additionally, the agency is not currently accepting premium processing requests with new I-140 petitions of these types. 

On May 24, 2022, USCIS officially introduced premium processing for pending EB-1C and EB-2 NIW I-140 petitions, and expanded the availability on August 1, 2022. 

In the announcement, USCIS confirmed its intention to continue expanding the availability of premium processing to additional I-140 petitions, Form I-539, Application to Extend/Change Nonimmigrant Status and Form I-765, Application for Employment Authorization.
