Temporary Protected Status Extended for Nationals of El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan

The Department of Homeland Security (DHS) plans to extend Temporary Protected Status for nationals of El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan to January 4, 2021. DHS will automatically extend the validity of Employment Authorization Documents, Forms I-797, Notice of Action, and Forms I-94, Arrival/Departure Record (collectively, TPS-related documentation) to this date.

DHS is extending the period of TPS in compliance with the preliminary injunctions put in place by federal court litigation.  However, if the government succeeds in these court cases, it will terminate TPS for citizens of Nicaragua and Sudan no earlier than 120 days from the date of the court decision and no earlier than 365 days from the date of any decision for citizens of El Salvador in order to allow for the safe and sustainable return of the affected TPS holders.

In the meantime, nationals of these countries who have TPS should consider alternative immigration options for living in the United States after their TPS expires.
